The contributions must have been made in a regular situation. The application for the root must be made in an irregular situation.
Examples:
- PEDRO" is an asylum seeker with a work permit, he contributes 6 months full time (he is contributing in a regular situation), then his asylum application is denied (he remains in an irregular situation) and he applies for the "arraigo laboral".
- "ANA" has family residency, works and pays contributions, but at the time of modification she does it out of time and loses her residency, but thanks to those previous contributions she can now request labor residency.
"Cotizo in regular situation but now he will ask for the arraigo in irregular situation".
And so on to hundreds of other options....
To request labor roots:
1) You must have been in Spanish territory for two years.
2) You must prove the existence of labor relations:
- 6 months of contributions as a full-time employee.
O - 12 months of part-time contributions.
O - 6 months of continuous self-employment contributions.
3)You must be in an irregular situation at the time of application.
