Do you immigrate alone with your child?

When we made the decision to emigrating alone with our children(not accompanied by the other parent), we must take into account that in order to regularize your minor child in Spanish territory you must prove that you have one of the following documents:

  1. Parental Rights
  2. The Custody
  3. Unilateral exercise of custody
  4. Or a notarized and apostilled power of attorney.

This documentation may also be required for:

  • Register your child.
  • Enroll in school
  • Any procedure involving their regularization: asylum, residence or Spanish nationality.

If your child is only recognized by you, you will not need any additional documentation other than an apostilled birth certificate.

If the other parent is deceased, an apostilled death certificate will suffice.
