Recently, the Secretary of State for Security and the Undersecretariat of the Ministry of the Interior have issued a new instruction with the aim of unifying criteria and improving efficiency in the processing of applications for international protection.

Key points

  • Application without prerequisites: No documentation such as passport or certificate of census registration is required.
  • Guaranteed access: You can apply for asylum at borders, police stations, immigration offices and CIEs.
  • Immediate protection: Since the application, the principle of no refund.
  • Mandatory interview: The applicant must explain his/her case and may be assisted by an interpreter, lawyer or cultural mediator.
  • Flexible term: Although it is recommended to apply for asylum in the first 30 daysIn some cases, late applications are accepted.
  • Right to appeal: If the application is denied, the applicant may file administrative and judicial appeals.

Manifestation of willingness and its impact on TD5

  • It is considered applicant for international protection to any person who express your will to apply for asylum before the competent authorities.
  • This means that, from that moment on, the applicant will no longer be able to access the Fifth Transitory Provision (DT5) of the new regulation, which regulates other regularization procedures.

Documents and assistance

  • Provisional documents: An application receipt is issued, and the Red Card with a residence permit and, after six months, the right to work.
  • Legal assistance: It can be provided by public defenders, specialized NGOs or a private attorney.
