In Spain, unlike in many countries, driving without a license is a FELONY, either because you have never exchanged or obtained a valid driver's license or because you have lost points after obtaining it.
If you drive under these circumstances and you are stopped, your vehicle will be immobilized by the competent authorities and will be placed at the disposal of the courts.
This crime is typified in article 384 of the Penal Code, as a crime against road safety and the penalties could be:
- Prison
- Fines or
- Community work
In addition, and very important for anyone who is in the process of obtaining a residency, this situation entails a POLICE REVIEW and/or CRIMINAL RECORDS, which would result in the impossibility of obtaining or renewing a Residency and even losing the opportunity to obtain Spanish Nationality, so do not let this situation damage your immigration process.
Therefore, we advise you to take care of your immigration process, so DO NOT DRIVE IF YOU DO NOT HAVE A DRIVER'S LICENSE IN SPAIN.
