Denial of residence on humanitarian grounds

Recall, the Spanish Government agreed in March 2019, to facilitate a residence permit of ONE YEAR (extendable), for humanitarian reasons for those VENEZOLAN people, who have been denied the asylum application and meet the conditions to qualify for this Residence.

Increasingly, Venezuelans are being denied residency for the following reasons:

  • Have dual nationality.
  • Have lived in a country other than Venezuela.
  • Have made a stopover in another country before arriving in Spain.
  • Have a police record in Spain.
  • Who have a criminal record in Spain.

Although each case will always be different, to date and taking into account the resolutions issued since December 2020, this is the reality of the situation.

Does this mean that I cannot apply for asylum if I am not Venezuelan or if I come from a third country?
No! This just means that you should be aware that if you fall into one of the above categories, it is quite likely that when you are denied asylum, you will also be denied Residency for Humanitarian Reasons.
